Cayman Tax Declared Unlawful

The Grand Court of the Cayman Islands has declared that two charges levied by the Utility, Regulation and Competition Office are unlawful: a 6% tax on the turnover of ICT providers, and a regulatory fee to cover the Office’s costs of regulating the ICT sector. Allowing the claim for judicial review, Kawaley J held that the 6% tax was unlawful because it had not been authorized by Parliament and that the regulatory fee was unlawful because the Office had not promulgated the regulations needed to render it payable.
